Bengaluru: Karnataka High Court Quashes Case Against Actress Ragini Dwivedi and Businessman Prashanth Ranka
The Karnataka High Court has dismissed the proceedings against actress Ragini Dwivedi and businessman Prashanth Ranka in the Sandalwood drugs case. Justice Hemant Chandangoudar stated that the prosecution failed to present any independent material evidence proving that the petitioners organized parties or sold drugs.

Details of the Case
The FIR was based on the voluntary statement of co-accused BK Ravishankar, recorded under Section 67 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The information alleged that drugs were consumed at various parties held in hotels and other locations, attended by celebrities, DJs, and software engineers.

On June 8, 2021, the police filed a charge sheet, naming Ragini Dwivedi and Prashanth Ranka as accused numbers 2 and 4, respectively. They were charged under multiple sections of the NDPS Act, including Sections 21, 21(C), 22(C), 27A, 27B, and 29, along with IPC Sections 120(B) (criminal conspiracy) and 201 (causing disappearance of evidence).

Arguments and Court Observations
Challenging the proceedings, the petitioners argued that aside from the voluntary statements of co-accused individuals, the prosecution had no corroborative evidence against them.

The court noted that the specific allegations against the petitioners were that they organized parties on July 5, July 8, and July 17, 2020, and distributed drugs at these events.

Referring to the Supreme Court judgment in Toofan Singh vs. State of Tamil Nadu, the court observed that a voluntary statement under Section 67 of the NDPS Act cannot be equated with a confession under Section 161 of the CrPC.

Lack of Evidence Leads to Quashing of Case
The court emphasized that the prosecution did not present any material evidence beyond voluntary statements of co-accused and charge sheet witnesses to prove that the petitioners organized parties or distributed drugs.

As a result, the court ruled, “Continuing criminal proceedings against the petitioners would constitute an abuse of legal process.”
